What we need to know

The 2003 Act makes it possible for individuals, their named person and legal representative to appeal their order in certain circumstances. Provided your application to appeal meets with the criteria, the Mental Health Tribunal for Scotland will arrange a tribunal to consider your appeal. You, your named person and legal representative will be automatically invited to attend your hearing and give evidence.

We need you to provide us with some information before we can arrange a hearing. Your legal representative or named person (if you have one) can assist you with this. This information must be signed before we can proceed further. We can only accept original documents and we are unable accept faxes.

We have published a suggested proforma. You do not need to use this format if you don't want to but we do need the information listed within it. You will find our address for correspondance on the proforma. If you are unsure of any of the details we require your Mental Health Officer or Responsible Medical Officer (RMO) will be able to help you.
