When the Mental Health (Care and Treatment)(Scotland) Act 2003 came into effect on 5 October 2005, Part 17 Chapter 3 of the Act concerning detention in conditions of excessive security was not enacted.
This legislation and associated regulations came into force on 1 May 2006 and the Tribunal Administration started to accept applications on that date.
Applications are made by sending a letter to the Tribunal containing the information specified in Rule 17A (1) to (3) of the amended Tribunal Rules of Procedure on the Office of Public Information website.

From 13 August 2007 the forms recommended for use under the Mental Health (Care and Treatment) (Scotland) Act 2003 (2003 Act) changed. From this date version 6.0 forms replaced version 5.0 forms.
The change over from version 5.0 to version 6.0 resulted in alterations to a number of forms. Some forms were deleted, others were amalgamated and some new forms were introduced.
